This change was required by the Health Information Technology for Economic and Clinical Health (HITECH) Act passed as part of American Recovery and Reinvestment Act of 2009. The Office of Personnel Management (OPM) has determined that several 2012 Federal Employee Health Benefits (FEHB) brochures contain an inaccurate statement under "Section 1. Facts about this HMO Plan". The inaccuracy appears in the grandfathered/non-grandfathered language as it applies under the Affordable Care Act (ACA). We have deleted the following incorrect statement from our brochure.
"As a non-grandfathered health plan (or option), this plan (or option) has also decided to follow the requirements that apply to grandfathered plans."
